Centre of Information and Media - Terms of Use

§ 1 Scope

Based on § 19 Abs. 1 Ziffer 10 of the Landeshochschulgesetz (Federal University Act) from 5 January 2005 (GBl. Nr. 1) and § 11 of the IMZ management regulations (Verwaltungsordnung für das IMZ) from 26 July 2004, the university senate agreed on the following terms of use on 8 December 2006.

The terms of use apply for all services provided by the centre of information and media (IMZ) at Ulm University.

§ 2 Services

According to § 6 of the IMZ regulations the IMZ provides the following services:

Reading rooms and catalogues

§ 3 Authorised Users


1. 
The services provided by the IMZ are available for Ulm University members (§ 9 Landeshochschulgesetz) for educational and work-related use.

2. 
Other German universities, universities of cooperative education, and people with a scientific and occupational interest may become users, if this does not interfere with the interests of users mentioned above (see 1) in any way. This also applies for university members who use the services for a secondary job.

§ 4 User Account

Admission to the department of infrastructure and basic IT services


1. 
Any Ulm University member can use the services of the department for basic IT services.

2. 
External third party users can hand in an application which then has to be approved by the head of department

Library membership


1. 
Everybody from 18 years of age can become a member. When creating a user account the members have to accept the terms of use, and must agree with the storage of personal data

2. 
Registered students of Ulm University automatically receive a user account with their registration. Their student card acts as their user card.

3. 
Other university members need to create an account at the library. Their university card (Hochschulausweis) acts as their user card

4. 
In order to receive a user card, external users have to apply with their ID and their full address. The head of department will decide if they are eligible to become a member.

§ 5 Code of Practise for Users

Registered users can access the services provided by the IMZ, but must comply with the terms of use.

The use of the facilities is subject to the Ulm University Code of Conduct (Hausordnung der Hochschule Ulm) from 8 November 2002. According to § 3 of the Code of Conduct, the IMZ directory or their representatives reserve the right to withdraw the use of facilities.

The users must


1. 
comply with the terms of use, follow the orders of the staff and avoid disturbing other users and the IMZ staff.

2. 
handle the data processing devices, library items and any equipment used with care.

3. 
present their user card if they are asked to do so by IMZ staff.

4. 
inform the IMZ about changes of name or the address without delay.

5. 
adhere to copyright laws

6. 
inform the IMZ staff about problems, damages and faults of computing facilities.

7. 
allow the head of department or their representatives (in compliance with data privacy) to access information about programmes and methods used, and show them the programmes used on request, in order to guarantee the appropriate use of the computing facilities.

8. 
follow the IMZ data privacy and security guidelines. The IT security guidelines are published on the Intranet and updated regularly in order to respond to the latest threats.

9. 
not pass on or use information they acquired about programmes or data belonging to others without permission.

10. 
make sure to backup their data stored locally on the computers. The IMZ does not provide any back-ups.

11. 
not try to acquire unauthorised access to programmes and information belonging to others (e.g. pass words, etc.)

12. 
comply with the relevant library policies – since the library is a scientific workplace.

13. 
not take any bags or jackets, etc. into the library. The staff are allowed to search the bag etc., if the rule is not complied with.

14. 
use the computers with Internet access in the library only for research that is connected with their studies, or research work. The computers with Internet access are only available for university members.

§ 6 Borrowing guidelines

The library provides free access to archives with lending and reference items (non-lending).

Not available for loan are usually reference items, material in special collections, or highly sensitive books. They can only be rented for a very short period, and this has to be approved by the library directory.



You can only borrow books or other items with a valid user card.


Your user card is not transferable.


The borrower is liable for any damages, and may not borrow any item(s) on behalf of a third party.


Please inform the library immediately, in case you lost your user card.


It is prohibited to remove any items from the library without following the appropriate borrowing procedure.


Users have to check the condition of the items before borrowing them, and point out any damages to the library staff. If the borrower has not pointed out any damages, it is assumed that the user received the items in perfect condition.

The library directory reserves the right to limit the number of books and items borrowed per user at a time.

It is possible to make reservations. If the user does not pick up the items within 5 working days from them being made ready for collection, the library reserves the right to lend them to other borrowers.

Usually a book has to be returned within for 4 weeks, other items within 2 weeks. The library reserves the right to reduce or prolong the loan period. The conditions for interlibrary loan can vary. In case of internal use, the library reserves the right to ask the user to return the item in question before the loan period has expired.

Members of Ulm University may borrow up to 50 items for educational use and research for an unlimited period of time. But they might be asked to put them at the disposal of other library users for a limited period of time.

If the loan period has expired, borrowed items have to be returned without any further notice. If the items are returned by mail or via the return book box, the user is liable for any loss or damages. The user is liable for any loss or damages of the borrowed items; this also includes notes, underlining, or damages on the registration chip.

§ 7 Opening hours and service

The IMZ directory and the President’s Office decide about the opening hours, which are published on notice boards and can be found on the website.

The heads of department reserve the right to change the opening hours for a limited period of time in particular cases.

The staff members of the IMZ are at your service during the usual opening hours.

§ 8 Fees


1. 
The services provided at the IMZ are free of charge for internal use at Ulm University. Please refer to our list of service charges (Dienstleistungskatalog)* concerning other services and the current Ulm University statutes (Satzung der Hochschule) regarding library fees.

2. 
For any IMZ services provided to external third parties, please refer to the guidelines for library fees of the Ulm University statutes.

§ 9 Reminders


1. 
For a loan that has become overdue, the library charges fees according to the latest Ulm University statutes (Satzung der Hochschule Ulm) regarding library fees. These fees are also to be paid, if the borrower has not received a written reminder.

2. 
If an item is not returned in response to the 4th reminder, the borrower will be charged with the standard cost for a replacement or the library will take measures in accordance with the federal confiscation act Landesverwaltungsvollstreckungsgesetz (LVwVG).

3. 
The user will be suspended from access to the library until the fines have been fully paid.

§ 10 Suspension from access to the library

Borrowers, who repeatedly or severely breached the terms of use or committed criminal offences, can be suspended from the access to the library permanently or for a limited period of time. The President’s Office decides about a permanent suspension.

The IMZ directory can pronounce a preliminary suspension until the final decision of the President’s Office has been made. A user’s suspension from access does not have any influences on any liabilities of the borrower towards the library. They still have to pay the fines claimed by Ulm University. The users are not entitled to any compensation for the suspension.

§ 11 Disclaimer

Ulm University’s liability for IMZ staff is limited to intent and gross negligence.

The IMZ is not liable for damages that might be caused by services that have been carried out inaccurately, incompletely, have been omitted, or delayed.

The IMZ is not liable for copyright violations by a user.

The IMZ is not liable for loss or damage of users’ possessions; this also applies for possessions stored in the lockers.

Users and their representatives are liable for any wilfully caused damaged during the use of IMZ facilities. This applies to damages caused by failure to follow the guidelines. This applies in particular to damages caused by copyright violations and not complying with security regulations. Users will have to pay a compensation for the damages caused. Users must exempt Ulm University from third party claims for damages.

§ 12 Discontinuation of membership


1. 
After the membership has been discontinued, any user data will be deleted from the university server. This also includes the e-mail address. The users can apply for the repayment of a print credit that exceeds 5.00 euros; any printing costs still owed to the university have to be settled.

2. 
Before discontinuing their membership, users must pay any charges, return all borrowed items including the user card to the library, and settle any obligations towards the IMZ.

3. 
The membership ends

1. 
for students with the termination of their registration,

2. 
for members of Ulm University when leaving the university,

3. 
for external users with the declaration of the user,

4. 
if the user is suspended from using the IMZ services according to § 10.

§ 13 Legal validity

The terms of use are effective immediately on being published. At the same time they replace the previous terms of use from September 1981 and March 2002.
